Business Law

That’s why we help ensure that your business documents and agreements are legally compliant and protect your rights – even under circumstances that you might not foresee. Well-written formation documents and agreements are the foundation from which a company can grow successfully and confidently. We can also help you amend your existing contracts to accommodate new circumstances. We address a variety of business documentation, including:

  • Incorporation Requirements
  • Partnerships, LLCs and LLPs
  • Contract Drafting
  • Contract Review

We are well-positioned to meet the legal needs of your business.

Litigation

Fraud & Liability
When someone fails to fulfill the terms of a contract, engages in deceptive practices, intentionally harms the business interests of another, or is accused of such actions, a legal dispute often arises. These situations can be highly stressful! You need solid legal representation to ensure that your interests are protected. GallardLaw has a track record of achieving favorable results for clients on a variety of fraud and liability issues, including:

  • Bad Faith Claims
  • Breach of Contract
  • Breach of Fiduciary Duty
  • Deceptive Practices
  • Liability Protection
  • Misrepresentation

Consumer Protection

GallardLaw helps clients take full advantage of federal and state laws protecting consumers against disreputable practices.

Consumer fraud comes in many forms, including:

  • False and misleading advertising
  • Overcharging
  • Adding on product charges without consumer notification
  • Falsifying the quality or quantity of the products
  • The “bait and switch” of ordering one product, but being delivered another
  • misrepresentations of the identity, geographic origin, condition (new vs. second-hand) or manufacturer or purveyor of goods or services
  • dishonoring written guarantees or warranties
  • Forcing the purchase of unnecessary services
  • Knowing of a product defect, but failing to notify and repair during the warranty period

These fraudulent business practices unfairly take advantage of unsuspecting customers. Consumers have the right to a fair marketplace when purchasing goods or services. We will aggressively represent you to recover any damages caused by unfair or deceptive practices from a fraudulent business, entity, product or service.

Pennsylvania’s Unfair Trade Practices and Consumer Protection Law prohibits sellers from fraudulent or deceptive conduct that creates a likelihood of confusion or of misunderstanding. If a seller has been unfair or deceptive to you, we can act on your behalf and ask the Attorney General or Pennsylvania Bureau of Consumer Protection to investigate, or seek a court injunction against such practices, and also pursue money damages for losses you may have suffered.

Intellectual Property

Protect your brand. Protect the original works you create. We can help you register copyrights or trademarks and police the market to protect your brands. Need better licensing agreements? We help protect your work and make sure others do not misuse or harm your brands. We help you confidently navigate disputes that arise from unauthorized replication or sharing of your idea.

Personal Injury

If you have been injured due to someone else’s negligence, you likely feel incredibly stressed and frustrated. It can be overwhelming to deal with the legal side of seeking justice while also trying to heal physically and emotionally, and doing your best to adjust to your new normal. That’s where GallardLaw comes in. Whether you were injured in a car accident, the victim of medical malpractice, or were injured in another way, we pledge to use our extensive knowledge and experience to help clients seek financial recovery for all the losses an injury can entail including:

  • Pain and suffering
  • Diminished quality of life
  • Lost income
  • Medical expenses
  • And much more

PA Bicyclist Accidents: An important Exception to Limited Tort.

Bike accident? Pennsylvania no fault rules do not apply to bike crashes. Insurance companies do not want you to know about this. Be sure to get a full and fair settlement.

Estate Planning

Every parent should have a will. A will gives you a say about who will care for your children and manage their finances, what happens to your property, and lets you decide who will handle your estate affairs. This is particularly true for LGBTQ parents.

If you own property, you need to plan ahead in order to make sure the right people or charities inherit your assets after your death. If you die without planning your estate, the Commonwealth of Pennsylvania has a default plan for the distribution of your assets, set forth in the “intestacy laws” which control the distribution of your estate in the absence of a will.

In addition to preparing your documents, we can discuss the importance of asset titling and beneficiary designations.

At GallardLaw, we can prepare wills for you and your partner, so nothing is left to chance if something unexpected happens.
